What is Estate Planning?

 .

An estate plan provides certainty as to what will happen to your assets in the event you pass away.  If you do not make an estate plan, your family may have  financial stress at a time of bereavement and loss as they do not know what is to happen to your assets.

1.  Wills Writing

.

The most basic and most important estate planning step is to write your Will.

If you do not have a Will, your assets may not go automatically to the people you love the most.  No one knows what your wishes and intentions are, so the law steps in to distribute them for you.

We dont recommend that you write your own Will or that you submit information online for your Will to be drafted.   You should get a properly qualified lawyer  (whom you are comfortable with) to help you with something as important as your last wishes.  A properly drafted Will ensures that your assets will go to the persons you love, and will not be disputed in court.

You should of course draw up a list of all your assets and your debts – your beneficiaries need to know what you own and what you owe.  Then you need to figure out how you intend to distribute your assets.

If your Will is not complicated, our fees for writing your Will is $500 and $300 for an LPA.  If you do both together, the fee is $590.

2.   Lasting Power of Attorney

.

The LPA is a legal document which allows a person who is at least 21 years of age (‘donor’), to voluntarily appoint a donee to make decisions and act on his behalf should he lose mental capacity one day. A donee can be appointed to act in the two broad areas of personal welfare and property matters.

3.   Applying for Grant of Probate

.

We act for executors named in the Wills.  We help an executor to apply for a Grant of Probate of that Will so that they can administer an estate of the deceased person.  The executor must collect the assets and distribute them to the beneficiaries according to the instructions in the Will.

Our fees for a straight forward probate application are $1,200 (not including GST and court fees).

4.  Applying for Letters of Administration

.

We act for relatives of a deceased person who died without a Will.   In this instance,  PKWA probate lawyers assist relatives of a deceased (who died without a Will) to apply for letters of administration so that the deceased’s estate can be properly managed and administered.  The deceased person’s assets have to be distributed according to the Intestate Succession Act.

Our fees for helping you to apply for Letters of Administration are $1,500 (not including GST and court fees).

5.  Estate Litigation

.

We represent clients in court disputes over Wills,  estate and trust assets or distributions. Estate litigation involves wills  that are disputed and estate disputes in cases where the executor has not carried out his job properly.
