Annulment of Marriage in Singapore
An annulment is a legal process that brings your marriage to an end. Once annulled, the marriage is treated as though it never existed in law. Unlike a divorce – which generally requires you to be married for at least three years – an annulment may be possible even if you have been married for less than three years, provided that you meet the legal criteria.
After a successful annulment, both parties’ marital status is restored to ‘single,’ unlike in a divorce where they are regarded as ‘divorcees.’

Grounds for annulment in Singapore
To annul a marriage in Singapore, one party must file proceedings stating that the marriage is either void or voidable.
Void marriages
Under Section 105 of the Women’s Charter, a marriage may be void on the following grounds:
- One person is already married.
- Someone is under 18 and has not been authorised to get married.
- Marriages between Muslims that are registered/solemnised under civil law.
- Where the marriage was not properly solemnised.
- The parties in the marriage are closely related by blood.
Voidable marriages
Under Section 106 of the Women’s Charter, a marriage may be voidable on the following grounds:
- The wife was already pregnant by another man at the time of the marriage.
- Due to one or both parties’ incapacity, the marriage has not been consummated.
- One party wilfully refuses to consummate the marriage.
- The marriage took place without valid consent – for example, due to duress, mistake, or a mental disorder.
How long does it take?
If the matter is uncontested, the annulment process takes about 4 to 5 months. At the end of the case, you will receive a Certificate of Nullity.
