As a probate lawyer, I am often asked – what do probate lawyers do?  Is it necessary to hire a probate lawyer in Singapore?

Nobody really likes to think about death.  Unfortunately, though, we all will die eventually – and that is why it is so important for all of us to have some estate planning.  This includes writing a will, get your LPA done and understanding the probate process.

When death in the family occurs, you would need to have a probate lawyer.

When probate is granted, if you are acting as the deceased’s executor or administrator, you are granted control of the assets.  You are then required to distribute the assets to the rightful beneficiaries.

 What is a Grant of Probate or a Letter of Administration?

 .

A Grant of Probate is a court order given out by the Family Justice Court, which means that the deceased’s original will is authentic, and the appointed Executor should carry out the deceased last wishes as stated in the Will.

 .

A Letter of Administration is a court order when there is no will. This order will specify who is the person who will administer the estate – usually that person is the surviving spouse, and then the children, or parents. The Administrator is obliged to distribute the deceased assets to the rightful beneficiaries. Usually, the immediate family members such as surviving spouse and surviving children will all get a share of the inheritance. The precise share is spelt out in the Intestate Succession Act.

Hence, it is very simple to remember – if your love one dies with a Will, you need to get a Grant of Probate. If your loved one dies without a Will, you need to get a Letter of Administration. The objectives of both court orders is are the same – to unlock the deceased’s assets, pay off debts and distribute the assets to the rightful beneficiaries.

How long does probate take?

It takes about 1 to 6 months for probate to be completed.  At PKWA Law, we are normally able to get probate quickly because of our experience. You would want to have probate done quickly so that you can quickly unlock the deceased’s assets and distribute them.
