What is probate and when is it required?
If there was a Will, the probate lawyer would apply to the court to obtain a Grant of Probate.
The Grant of Probate is a court document where the court:
Formally approves the Will as the last valid Will of the deceased;
Appoints the executor named in the will to administer the estate and to distribute the assets to the beneficiaries named in the will. an estate according to a Will.
What if there was no Will?
If the deceased did not leave behind a Will giving clear instructions on how to distribute his assets, the probate process gets more complicated. It will be longer and more expensive. In this case, the probate lawyer applies to the court to obtain a Letter of Administration. This is a court order that authorises the closest next of kin to administer the estate and to distribute the inheritance to the lawful beneficiaries.
