The Law Society’s Highest Honour in Family Law

A member of our family law team received the inaugural Practice Excellence Award for Family Law from the Law Society of Singapore in 2025. As the Law Society’s highest professional honour, the award reflects the expertise, professionalism and trusted reputation of PKWA Law’s divorce and family law team.

Landmark Divorce Wins at High Court and Court of Appeal

Our first priority is always to resolve the matter constructively, in a calm and respectful manner. When litigation becomes necessary, we take a firm, decisive, and strategic approach to protect your interests, as reflected in the following Court of Appeal and High Court cases:

1.   Major Court of Appeal Victory – One of the Largest Increases in Singapore Divorce History – From 25% to 75% of Matrimonial Assets for Husband (Increase from $3.4 Million to $10.2 Million)

In TQU v TQT [2020] SGCA 08, the High Court awarded the husband just 25% of $13.6 million in matrimonial assets. Dissatisfied with this outcome, he engaged PKWA Law’s family law team for his appeal.

Our family lawyers helped the client secure a dramatic reversal. The Court of Appeal released a 60-page judgment, describing the long-drawn litigation of more than 10 years as complicated,” “challenging,” and “highly unusual.”

The Court of Appeal increased his share from $3.4 million to $10.2 million (from 25% to 75%). This is one of the most substantial increases in Singapore’s divorce history.  Read case summary here and Judgment here.

2.   High Court Win – $6.3 Million Award for Homemaker Wife After Six-Year Battle

In WOS v WOT [2024] SGHC(A) 11, our team obtained an award of over $6.3 million in matrimonial assets for the Wife, who is a homemaker. The victory was achieved after 6 years of litigation in the High Court against a five-member legal team led by a Senior Counsel. Read Judgment here.

3.   $41 Million in Assets Successfully Protected From Division

PKWA Law acted for the Husband in a high-net worth divorce where the Wife sought to include $41 million in assets and inheritance funds as part of the matrimonial assets for division.  We successfully protected the Husband’s assets of $41 million from being included in the matrimonial assets.

4.   Court of Appeal Victory – Higher Share Under New Division Law

In Twiss, Christopher James Hans v Twiss, Yvonne Prendergast [2015] SGCA 52, we successfully argued for the Husband in one of the first Court of Appeal cases under Singapore’s new law on division of matrimonial assets. Read Judgment here.

5.   High Court Success – Recovery of Over $3 Million in Hidden Assets for Wife

In WGG v WGH [2022] SGHCF 25, reported by The Straits Times (Oct 2022), our team uncovered over $3 million in hidden assets, which was then put back into the asset pool for division. Read Judgment here.

6.   High Court Victory – Client Awarded 72.5% of Matrimonial Assets ($2.7 Million)

In XIK v XIL [2025] SGHCF 16, the court awarded our client 72.5% of matrimonial assets, totalling over $2.7 million. Read case summary here and Judgment here.

7.   High Court Victory – Hidden Assets and Custody

In WTL v WTM and another appeal [2024] SGHCF 40, we successfully argued that the other party had failed to make full disclosure of wealth (forcing the value of hidden assets to be added back to the pool), and secured the award of care and control of the children for our client in a complex, multi-issue High Court appeal. Read Judgment here. The Straits Times (5 July 2025) reported the case here.

8.   Setting aside a Prenuptial Agreement & Tracing Hidden Global Assets Across 4 Jurisdictions

In VYJ v VYK [2021] SGFC 125, we successfully set aside a Prenuptial Agreement, traced undisclosed assets across four international jurisdictions, and obtained a 55% asset division for our client.

Divorce Requirements & Process in Singapore (2026 Update)

1.   Am I Eligible to File?

To file for a civil divorce under the Women’s Charter, you must meet these criteria:

  • The 3-Year Rule: You must have been married for at least 3 years (exceptions apply for “exceptional hardship”).
  • Residency: Either you or your spouse must be a Singapore Citizen or have lived in Singapore for 3 continuous years.
  • Mandatory Programme: Parents with children under 21 must complete the Mandatory Co-Parenting Programme (CPP) before filing.

2.   Legal Facts for Divorce (Including Divorce by Mutual Agreement)

You must prove the marriage has irretrievably broken down using one of these facts:

  • Divorce by Mutual Agreement (DMA): Introduced in July 2024, divorce by mutual agreement allows parties to divorce without blaming each other (“no fault, no blame divorce”). A written agreement is required, setting out the reasons for the divorce and the reconciliation efforts.
  • Separation: 3 years (with consent) or 4 years (without consent).  While separation for 3 or 4 years has long been a “no-fault” option in Singapore, the new Divorce by Mutual Agreement allows couples to achieve the same amicable result without the requirement of living apart for 3 or 4 years before filing.
  • Fault-Based: Unreasonable Behavior, Adultery, or 2 years of Desertion.

3.   The Two-Stage Roadmap

Singapore follows a mandatory two-stage procedure:

Stage 1: Dissolution of Marriage (Interim Judgment)

  • The court first considers whether the marriage has broken down irretrievably.  If satisfied, it grants an Interim Judgment. This is a provisional divorce legally confirming that the marriage is over.

Stage 2: Ancillary Matters & Final Judgment

  • Once the divorce is granted, the court addresses ancillary issues, including the division of matrimonial assets, child custody and access arrangements, and maintenance for the spouse and children. These matters may be resolved by agreement, mediation, or court determination.
  • Once all ancillary matters are settled and 3 months have passed from the date of the Interim Judgment, you can apply for the Final Judgment, which officially concludes the divorce.

While the legal stages remain the same, your timeline and costs will depend on whether your case proceeds on a Simplified (Uncontested) or Normal (Contested) track.

How We Help You Navigate Divorce in Singapore

Divorce in Singapore is governed by the Women’s Charter and handled by the Family Justice Courts. Our divorce lawyers will help you understand whether you meet the legal requirements to file for divorce, advise on whether an uncontested or contested divorce is the most appropriate option based on your circumstances, and guide you through the divorce process from start to finish.

Our team will also advise you on ancillary matters, including arrangements for child custody, division of matrimonial assets, spousal and child maintenance, and issues relating to CPF and HDB flats.

How We Help You with an Uncontested Divorce

For couples who agree on an uncontested divorce, our lawyers ensure your rights are fully protected, and that the agreement on the divorce, custody, division of assets, and maintenance is legally sound and complies with Singapore law.

How We Protect You in a Contested Divorce

When disputes arise over the divorce, child custody, asset division, or maintenance, our team adopts a strong, strategic approach to safeguard your interests, represent you in negotiations and court hearings, and secure the best possible outcome for you and your family.

How We Help You Using Therapeutic Justice and Mediation

While we are experienced litigators, our team also adopts the Singapore Family Justice Courts’ Therapeutic Justice framework. We believe that a divorce is not just a legal conclusion, but a deeply personal transition that requires a “lens of care.” Our approach is to move away from unnecessary confrontation and toward thoughtful problem-solving solutions.

This is why our team also includes Accredited Mediators with the Singapore Mediation Centre and Accredited Collaborative Family Practitioners (CFP), giving clients more positive ways to resolve disputes. Our constructive approach often leads to:

  • Lower legal costs.
  • Faster resolution.
  • Peace and long-term family stability.

Oct 2025 - I cannot recommend Ms. Dorothy Tan and her assistant, Ms. Hong Hui, highly enough. Having just concluded my divorce case with the best possible outcome, I feel compelled to share my experience for anyone seeking truly exceptional legal representation. From the outset, Ms. Tan's expertise and experience were evident. She didn't just handle my case; she mastered it. She and Ms. Hong Hui presented different strategic ways to approach the situation, which was incredibly reassuring. Their patience and hard work in meticulously piecing together my accounts was nothing short of brilliant. They took the time to understand the nuances and built a strong, coherent case. During the mediation sessions, their professionalism was outstanding. Ms. Tan consulted me at every single step, ensuring I was fully informed and comfortable with the direction. She didn't just present options; she provided clear, proper analysis on the potential outcomes, advising me on the best solutions with wisdom and clarity. A special mention must be made for Ms. Hong Hui, whose dedication and support were invaluable throughout this challenging process. The entire team is a credit to the legal profession. Thank you, Ms. Tan and Ms. Hong Hui, for your unwavering support, hard work, and for guiding me to such a successful resolution. I am deeply grateful.

Sean Kock

I want to take a moment to sincerely thank Mr. Derek Choo and Ms. Jennifer Tung for their outstanding guidance throughout my divorce process. Their professionalism and compassionate approach made a challenging time in my life much more manageable. Their attention to detail and expertise instilled confidence in me, while their strategic mindset ensured that my best interests were always prioritized. Communication was prompt, clear, and reassuring, creating a strong sense of support when needed. I wholeheartedly recommend their services to anyone seeking dedicated and empathetic legal counsel. Once again, thank you!

June Leow

Christopher Twiss

In my hour of need, I was recommended to PKWA. Dorothy Tan LISTENED to my case and worked tirelessly over the holidays and weekends to meet impossible deadlines. A very upsetting and stressful time, but I will be forever grateful as Dorothy believed in my case and sought a fair and just resolution against insurmountable odds. At every juncture, Dorothy provided realistic, honest assessments and I proceeded based on her recommendations. If Dorothy and her team decide to champion your cause, you should consider yourself very fortunate.

Jing Lou

Words cannot express my thanks to PKWA and to Ms. Charlene Nah and Mr. Jason Mak for their kind help. My divorce case went through mediation, district court hearing and then appeal hearing. It went on for more than two years and to make the matters even more complicated, I am doing this from overseas. Charlene and Jason are there with me every step of the way, providing their professional service and also some personal touch to make the case easier for me emotionally. They are very experienced with Singapore Family Law and always have my best interest at heart. At the latter part of the district hearing and appeal hearing, I was struggling with legal fees, because the case went on much longer than I expected, due to my ex-husband's stubbornness. Charlene went out of her way to help me cope with the difficulties, even encouraged and helped me to represent myself at appeal court. The outcome is very favorable and there's no way I would be able to accomplish that without Charlene and Jason's kind help. Divorce is unfortunate and difficult in its nature, and you'd need your lawyers to have your best interest at heart at all times to overcome the difficulties. PWKA is such a law firm you can fully trust. I can't thank them enough.

Kinloong Ng

Clara Tan

I have engaged PKWA for my divorce proceedings after doing some research and I have made the right choice. My case was assigned to their lawyer, Derek Choo and legal manager, Firdaus. Derek is very thoughtful and efficient; he has explained my rights over the matrimonial home and assets. He has provided valuable guidance during mediation session. He even followed up my case and called during his reservist to discuss. Firdaus is very responsive and followed up timely in administrative works. He even helped to deliver the legal paper personally to my ex-spouse after the 1st attempt failed. Both gentlemen have gone above and beyond the call of duty to ensure things are on track. I am very satisfied with the outcome of the final judgement. Highly recommended PKWA for their excellent service.

Mongkol Kittiratanasakul

I would like to especially thank Ms Charlene Nah and Mr Jason Mak for their extraordinary help during that trying period of time. Despite the circumstances, I felt that Ms Charlene was genuinely trying to help. I would definitely turn to them in future for legal advice.

Samantha Lim

Jason Mak and Charlene Nah have both been most patient and professional throughout the entire process.
