Q: What are the legal grounds for divorce in Singapore?

The only ground for divorce is the irretrievable breakdown of the marriage under the Women’s Charter. This can be proven by one of six facts: Adultery Unreasonable behaviour Desertion for at least 2 years Separation for 3 years (with consent) Separation for 4 years (without consent) Divorce by Mutual Agreement (DMA) – introduced on 1 July 2024, allowing couples to jointly agree that the marriage has broken down without needing to prove fault.

Q: What is Divorce by Mutual Agreement (DMA)?

DMA is a new, no-fault divorce option in Singapore. Both spouses must agree that the marriage has irretrievably broken down and file a written agreement setting out: Why they believe the marriage cannot continue Efforts at reconciliation Proposed arrangements for children and finances The Court must be satisfied that the agreement is fair before granting the divorce. DMA reduces blame and conflict and is designed to give couples a more amicable way to separate.

Q: Can I file for divorce on the ground of adultery?

Yes. Adultery is one of the recognised facts to show irretrievable breakdown of a marriage. The spouse filing must show that adultery occurred and that it is intolerable to continue living with the other party. Evidence is usually required, such as private investigator reports, messages, or clear admissions. To use adultery as a ground for divorce: You must file within 6 months from the date you found out about the adultery. If you continued to live with your spouse for more than 6 months after discovering the adultery, the Court may consider that you condoned the act. In that case, you cannot rely on adultery as your ground for divorce.

Q: What if I cannot prove adultery but strongly suspect it?

If there is not enough evidence for adultery, you may still rely on unreasonable behaviour. For example, unexplained overnight absences, close relationships with a third party, or neglect of the marriage may be sufficient for the Court to find unreasonable behaviour.

Q: How are children’s custody and care decided in a divorce?

The Court’s primary concern is the welfare of the child. Custody (long-term decision-making authority) is usually joint, while care and control (day-to-day living arrangements) may be awarded to one parent. The other parent is typically granted access rights. Parents with children under 21 must also attend the Mandatory Co-Parenting Programme (MCPP) before filing for divorce.

Q: How is property divided in a divorce?

All matrimonial assets - including properties, CPF monies, savings, and investments - are divided in a manner the Court finds just and equitable. Both financial contributions (e.g. paying for property, mortgage, expenses) and non-financial contributions (e.g. childcare, homemaking) are considered. The Court has broad discretion, and settlements often involve both property transfers and CPF refunds.

Q: How long does the divorce process take?

Uncontested divorce: Typically 1-4 months to obtain the Interim Judgment, with the Final Judgment granted 3 months later. Contested divorce: May take 12-18 months or longer, depending on the number and complexity of disputes.

Q: How much does a divorce cost in Singapore?

Uncontested divorce: More affordable, with fixed-fee packages starting from around $1,500 to $4,000. Contested divorce: Costs vary depending on complexity, hearings, and mediation, and are significantly higher due to the extended process.

Q: What is the difference between contested and uncontested divorce?

Uncontested divorce: Both parties agree on the divorce and all terms (custody, maintenance, property division). The process is faster, simpler, and cheaper. Contested divorce: Parties cannot agree on one or more issues. The case involves mediation, written submissions, and hearings, and the Court makes the final decision.

Q: Can foreigners file for divorce in Singapore?

Yes. Foreigners may file for divorce if either spouse is domiciled in Singapore or has been habitually resident here for at least 3 years before filing.

Court of Appeal Win – One of the Largest Increases in Divorce History – In TQU v TQT [2020] SGCA 08, the husband was originally awarded just 25% of $13.6 million in matrimonial assets by the High Court. After engaging our team for his appeal, the Court of Appeal reversed the decision, increasing his share from 25% to 75% — up from $3.4 million to $10.2 million. The Court of Appeal issued a 60-page judgment, describing the case as “complicated,” “challenging,” and “highly unusual.”

Court of Appeal Win – Higher Share Under New Division Law – In Twiss, Christopher James Hans v Twiss, Yvonne Prendergast [2015] SGCA 52, we successfully argued for the husband in one of the first Court of Appeal cases under Singapore’s new law on the division of matrimonial assets.

High Court Victory – Uncovering $3 Million in Hidden Assets – In a case reported by The Straits Times (Oct 2022), we successfully acted for the wife in a High Court case where the husband had “gone all out to hide over $3 million” from her.

$6 Million Win for Homemaker After Six-Year Battle – In WOS v WOT [2024] SGHC(A) 11, we secured over $6 million in assets for the homemaker wife in the High Court after a protracted six-year legal battle. Our team prevailed against a five-member legal team led by a Senior Counsel.

High Court Success – 72.5% of Matrimonial Assets Awarded – In XIK v XIL [2025] SGHCF 16, we successfully obtained a substantial 72.5% of matrimonial assets for the husband in the High Court.
