Landmark Divorce Wins at High Court and Court of Appeal

1. Major Court of Appeal Victory – One of the Largest Increases in Singapore Divorce History – From 25% to 75% of Matrimonial Assets for Husband (Increase from $3.4 Million to $10.2 Million)
In TQU v TQT [2020] SGCA 08, the High Court awarded the husband just 25% of $13.6 million in matrimonial assets. Dissatisfied with this outcome, he engaged PKWA Law’s family law team for his appeal.
Our family lawyers helped the client secure a dramatic reversal. The Court of Appeal released a 60-page judgment, describing the long-drawn litigation of more than 10 years as “complicated,” “challenging,” and “highly unusual.”
The Court of Appeal increased his share from $3.4 million to $10.2 million (from 25% to 75%). This is one of the most substantial increases in Singapore’s divorce history. Read case summary here and Judgment here.
2. High Court Win – $6.3 Million Award for Homemaker Wife After Six-Year Battle
In WOS v WOT [2024] SGHC(A) 11, our team obtained an award of over $6.3 million in matrimonial assets for the Wife, who is a homemaker. The victory was achieved after 6 years of litigation in the High Court against a five-member legal team led by a Senior Counsel. Read Judgment here.
3. $41 Million in Assets Successfully Protected From Division
PKWA Law acted for the Husband in a high-net worth divorce where the Wife sought to include $41 million in assets and inheritance funds as part of the matrimonial assets for division. We successfully protected the Husband’s assets of $41 million from being included in the matrimonial assets.
4. Court of Appeal Victory – Higher Share Under New Division Law
In Twiss, Christopher James Hans v Twiss, Yvonne Prendergast [2015] SGCA 52, we successfully argued for the Husband in one of the first Court of Appeal cases under Singapore’s new law on division of matrimonial assets. Read Judgment here.
5. High Court Success – Recovery of Over $3 Million in Hidden Assets for Wife
In WGG v WGH [2022] SGHCF 25, reported by The Straits Times (Oct 2022), our team uncovered over $3 million in hidden assets, which was then put back into the asset pool for division. Read Judgment here.
6. High Court Victory – Client Awarded 72.5% of Matrimonial Assets ($2.7 Million)
In XIK v XIL [2025] SGHCF 16, the court awarded our client 72.5% of matrimonial assets, totalling over $2.7 million. Read case summary here and Judgment here.
7. High Court Victory – Hidden Assets and Custody
In WTL v WTM and another appeal [2024] SGHCF 40, we successfully argued that the other party had failed to make full disclosure of wealth (forcing the value of hidden assets to be added back to the pool), and secured the award of care and control of the children for our client in a complex, multi-issue High Court appeal. 8. Setting aside a Prenuptial Agreement & Tracing Hidden Global Assets Across 4 Jurisdictions
In VYJ v VYK [2021] SGFC 125, we successfully set aside a Prenuptial Agreement, traced undisclosed assets across four international jurisdictions, and obtained a 55% asset division for our client.
Divorce Requirements & Process in Singapore (2026 Update)
1. Am I Eligible to File?
To file for a civil divorce under the Women’s Charter, you must meet these criteria:
- The 3-Year Rule: You must have been married for at least 3 years (exceptions apply for “exceptional hardship”).
- Residency: Either you or your spouse must be a Singapore Citizen or have lived in Singapore for 3 continuous years.
- Mandatory Programme: Parents with children under 21 must complete the Mandatory Co-Parenting Programme (CPP) before filing.
2. Legal Facts for Divorce (Including Divorce by Mutual Agreement)
You must prove the marriage has irretrievably broken down using one of these facts:
- Divorce by Mutual Agreement (DMA): Introduced in July 2024, divorce by mutual agreement allows parties to divorce without blaming each other (“no fault, no blame divorce”). A written agreement is required, setting out the reasons for the divorce and the reconciliation efforts.
- Separation: 3 years (with consent) or 4 years (without consent). While separation for 3 or 4 years has long been a “no-fault” option in Singapore, the new Divorce by Mutual Agreement allows couples to achieve the same amicable result without the requirement of living apart for 3 or 4 years before filing.
- Fault-Based: Unreasonable Behavior, Adultery, or 2 years of Desertion.
3. The Two-Stage Roadmap
Singapore follows a mandatory two-stage procedure:
Stage 1: Dissolution of Marriage (Interim Judgment)
- The court first considers whether the marriage has broken down irretrievably. If satisfied, it grants an Interim Judgment. This is a provisional divorce legally confirming that the marriage is over.
Stage 2: Ancillary Matters & Final Judgment
- Once the divorce is granted, the court addresses ancillary issues, including the division of matrimonial assets, child custody and access arrangements, and maintenance for the spouse and children. These matters may be resolved by agreement, mediation, or court determination.
- Once all ancillary matters are settled and 3 months have passed from the date of the Interim Judgment, you can apply for the Final Judgment, which officially concludes the divorce.
While the legal stages remain the same, your timeline and costs will depend on whether your case proceeds on a Simplified (Uncontested) or Normal (Contested) track.
