“How long would my divorce case take?” This is usually a question that will pop-up in the minds of a couple contemplating divorce in Singapore.

Generally, if your divorce is uncontested (where parties have a mutual agreement for the divorce and all ancillary matters), you would be able to get an Interim Judgment (provisional divorce) within 1 month from the filing of your divorce papers.

The divorce process may take a longer duration in contested divorce cases (where parties are unable to reach a common consensus on a divorce and ancillary matters). In such situation, the divorce process on average takes about a year.  In some cases where the divorce and ancillaries are bitterly contested, the divorce case may take more than one year.

In most of our cases, parties are able to reach a settlement in the midst of their divorce, and such settlement usually takes place after parties exchanged financial documents, salary slips, proof of expenses, list of assets and parenting plan.

According to the Family Justice Court’s official statistics in 2016, 74% of divorce cases were settled within the year they were filed.

Common reasons why parties reach a settlement usually include:

  1. The possible costs that may be incurred if parties goes to trial;
  2. Stressful litigation process for parties and also their children; and
  3. Lack of certainty in outcome if parties proceed to litigate;
