Divorce proceedings are started by one spouse filing a Writ for Divorce at the Singapore Family Justice Court. The spouse seeking a divorce is called the Plaintiff and the other spouse is called the Defendant.

Do you satisfy the initial requirements for Divorce in Singapore?

In order to obtain a divorce in Singapore, you must meet the following requirements in the Women’s Charter:

  1. Be a Singapore citizen or Permanent Resident.
  2. Lived in Singapore for at least 3 years immediately before applying for a divorce, or are domiciled in Singapore
  3. Have been married for at least 3 years before you file for divorce.

Once you qualify for divorce in Singapore, you must show that your marriage has broken down irretrivably

Singapore law recognises only one ground for divorce in Singapore, namely,  “that the marriage has broken down irretrievably”.  Under section 95(3) of the Women’s Charter, “irretrievable breakdown” can be proven by establishing any of the following 5 facts:

  1. Separation of at least 3 years (consent of the defendant is required).  This is a “no fault’ divorce.
  2. Separation of 4 years (consent of the defendant is not required).
  3. Adultery – The Defendant has committed adultery, and the Plaintiff finds it intolerable to live with the Defendant.
  4. Unreasonable behaviour – The Defendant has behaved in such a way that the Plaintiff cannot reasonably be expected to live with the Defendant. Y
  5. The Defendant has deserted the Plaintiff for at least 2 years.

The vast majority of divorces are based on the “facts” of either separation or unreasonable behaviour.

How long does divorce take?

The vast majority of divorces are not contested at the beginning, or will turn uncontested subsequently.  It is very rare for a divorce case to be contested.  This is because who divorces whom and whose fault caused the divorce have little bearing on how the court decides on division of assets, maintenance and children issues.

If you divorce is uncontested right from the start, we call this a Simplified Divorce or Uncontested Divorce.  At PKWA Law, we normally obtain the Interim Judgment(provisional divorce) for  Simplified Uncontested Divorce within 4 to 6 weeks of you engaging us, followed by the Final Judgment in 3 months’ time.  The process in a Simplified Uncontested Divorce does not require the couple to attend court in person.

If the divorce is contested, the process may take about 6 months to 12 months to conclude.
