PKWA Law was recently quoted by Channel NewsAsia (CNA) in an article examining why some unwed single parents in Singapore choose to legally adopt their own biological children.

The article, titled “I gave birth to her, so why do I have to adopt her?’: The unwed single parents adopting their own children”, looks at the legal issues faced by parents of children born outside marriage, including matters relating to the child’s legal status, inheritance, housing and other practical considerations.

What Changes When a Biological Parent Adopts Their Own Child?

Speaking to CNA, Derek Choo, Associate Director of the Family Law and Probate Department at PKWA Law Practice, explained that a parent does not cease to be the legal parent of a child simply because the child was born outside marriage.

The biological parent continues to have parental rights and legal responsibilities towards the child. However, Singapore law continues to distinguish between children born within marriage and those born outside marriage in certain legal contexts.

As Derek explained to CNA:

“What changes with adoption is the child’s legal status, not the relationship itself.”

He added:

“Singapore law still distinguishes between a child born within marriage and one born outside it, and for many unwed mothers, adopting their own child is the clearest way to close that gap.”

The CNA article explores some of the reasons why an unwed biological parent may consider adopting his or her own child, including concerns surrounding inheritance, housing eligibility, tax relief and the legal relationship between the child and the other biological parent.

It also highlights the practical requirements involved in the adoption process. Biological parents seeking to adopt their own children are generally subject to core pre-adoption requirements, which may include a mandatory briefing, an Adoption Suitability Assessment, interviews, home visits and a court application.

The circumstances of every parent and child are different, and whether adoption is appropriate will depend on the family’s particular legal and personal circumstances.

PKWA Law is pleased to announce that we are a participating law firm in the Singapore Academy of Law’s (SAL) newly launched Wills Repository Service.

Clients who have their Wills prepared by PKWA Law can now arrange through us for a digital copy of their Will to be securely deposited with SAL. The service provides an additional way for nominated authorised persons to locate and access a copy of the Will when it is needed.

Importantly, the digital copy does not replace the original signed Will, which should continue to be kept safely by the testator.

What is the SAL Wills Repository Service?

SAL launched the Wills Repository Service on 9 September 2026 at TechLaw.Fest. It builds on the existing SAL Wills Registry, which SAL has administered since 2020. The existing Wills Registry records whether a Will exists, who prepared it and where the original signed Will is kept. It does not store the Will itself.

The new Wills Repository Service goes a step further.

Through a participating law firm such as PKWA Law, an individual can arrange for a digital copy of his or her Will to be securely deposited with SAL. The individual can also nominate authorised persons who may access the digital copy after his or her death.

Digital copies deposited with SAL are protected by encryption and strict access controls and may only be accessed by persons nominated and authorised by the testator.

Why Can This Be Useful?

Making a Will is only one part of proper estate planning. It is also important that the Will can be located when it is eventually needed.

Justice Aidan Xu, speaking at the launch of the new service, explained that the Wills Repository provides an additional point of reference where the original paper Will cannot be found, helping to reduce the time, uncertainty and stress involved in locating a Will.

The Repository therefore provides an additional safeguard. If there is difficulty locating the original Will, nominated authorised persons can obtain access to the digital copy deposited with SAL.

However, clients should understand the limits of the service. A digital copy deposited with SAL does not replace the original signed Will and does not determine whether the Will is legally valid. The original signed Will should therefore continue to be kept safely.

How PKWA Law Can Assist

Clients who wish to use the service must engage a participating law firm such as PKWA Law to prepare their Will. The client nominates the persons who will be authorised to access the digital copy after death, and PKWA Law then deposits the digital copy with SAL on the client’s behalf.

For eligible clients, PKWA Law can:

If you already have a Will, this may also be a useful opportunity to review whether it continues to reflect your current wishes and circumstances before a digital copy is deposited.

Fees

SAL is currently offering complimentary deposits under the Wills Repository Service until 31 March 2027. After 31 March 2027, SAL will charge a fee of $110.

PKWA Law charges a $100 service fee for arranging the digital deposit for clients whose Wills are prepared by us. Any applicable SAL fee is separate from PKWA Law’s service fee.

After 31 March 2027, SAL’s prevailing fee will apply in addition to PKWA Law’s service fee.

An Additional Safeguard for Your Will

The SAL Wills Repository Service is a useful addition to estate planning, but it does not change the importance of having a properly prepared Will and keeping the original signed document safely.

The Wills Registry helps record the existence and location of the original Will. The new Wills Repository Service adds another layer by allowing an authorised person to access a securely stored digital copy when needed.

PKWA Law can now assist clients to prepare their Will and arrange for a digital copy to be deposited with SAL.

2 August 2026 – Our Head of Family Law, Low Jin Liang, recently participated in a dialogue hosted by the Ministry of Law and Minister for Law, Edwin Tong, together with members of the family law community.

The session brought together legal practitioners and other stakeholders to exchange views on Singapore’s family justice system and discuss how families experiencing divorce and related disputes can be better supported.

In his Facebook post following the diaglogue, Minister Tong observed that “divorce is one of the most painful and disorienting experiences” many families face, with its effects often continuing long after legal proceedings have concluded, particularly where children are involved.  He also noted that the therapeutic justice model represents a shift towards a more healing and family-centred approach.

As family lawyers, we appreciate the opportunity to participate in this dialogue and to contribute practical perspectives drawn from our experience assisting clients through some of the most challenging periods of their lives.

We are grateful to the Ministry of Law and Minister Tong for the invitation to participate in this dialogue and look forward to continuing to contribute to the ongoing development of Singapore’s family justice system, including initiatives that further strengthen therapeutic justice and support families navigating divorce.

PKWA Law was interviewed by The Straits Times on the topic of divorce by mutual agreement, one of the most significant reforms to Singapore’s divorce laws in recent years.

In the article, PKWA Associate Director Jessica Chow explained how the new framework operates in practice and highlighted that couples relying on divorce by mutual agreement must demonstrate that they have genuinely explored reconciliation before concluding that the marriage has irretrievably broken down.

Jessica explained that the option allows couples to move away from fault-finding towards problem-solving – which matters most where there are children. Where parents are not locked into an adversarial contest over blame, she noted, they are generally better able to communicate and work together on decisions affecting their children.

Jessica also noted that if the Family Justice Courts are not satisfied that sufficient reconciliation efforts have been made, or if there remains a real prospect of reconciliation, the court may delay or decline to grant the divorce.

The article explores how the new legal framework has reduced the need for spouses to assign blame for the breakdown of their marriage while maintaining appropriate safeguards to ensure that divorce remains a considered decision.

PKWA Law was interviewed by The Straits Times on the reasons why unreasonable behaviour continues to be the most commonly cited fact in civil divorce proceedings in Singapore.

According to the latest marriage and divorce statistics released by the Department of Statistics, unreasonable behaviour accounted for 48.7% of all civil divorces in 2025, while adultery was cited in just 0.9% of cases.

In the article, PKWA’s Lim Chong Boon explained that many marriages which break down because of infidelity are nevertheless filed on the basis of unreasonable behaviour.

This is often because proving adultery requires clear evidence that a spouse had a sexual relationship with another person. Gathering such evidence may involve engaging a private investigator or relying on other forms of evidence, which can increase both the complexity and cost of the proceedings. By contrast, unreasonable behaviour covers a broad range of conduct and is often the more practical legal basis for commencing divorce proceedings.

The introduction of divorce by mutual agreement in July 2024 has also provided couples with another option where both parties agree that the marriage has irretrievably broken down without attributing blame to either spouse. Nevertheless, unreasonable behaviour remains the most commonly relied upon fact for civil divorces.

At PKWA Law, our family lawyers advise clients on the most appropriate legal approach based on their individual circumstances. Every family situation is different, and the choice of the fact to rely upon should take into account the available evidence, the parties’ objectives and the overall circumstances of the marriage.

If you are considering divorce and are unsure which fact best fits your circumstances, our family law team is available for a confidential discussion.
