In an annulment in Singapore, the marriage is cancelled between a man and a woman. The marriage is deemed to have never technically existed and was never valid.
Annulment vs Divorce in Singapore
There are two ways to legally end a marriage – annulment and divorce. In an annulment, the marriage is cancelled between a man and a woman. The marriage is deemed to have never technically existed and was never valid. You revert back to single status.
A divorce is the ending of a valid marriage between a man and a woman. The marriage did exist, just that it has now ended.
If you are applying for an annulment, you do not have to wait for the marriage to cross 3 years – the law enables you to file for an annulment before 3 years of marriage. If you are applying for a divorce, you must be married for 3 years before you can file your divorce application.
A marriage can only be annulled if it is void or voidable.
Marriages that are Void:
Marriages which are deemed to be void are:
Marriages between Muslims that are registered/solemnised under civil law;
Where one party is already married;
Where one party is below the age of 18 and has not been granted permission to marry;
Parties to the marriage being closely related.
Marriages that are Voidable:
A marriage is voidable in the following situations:
Non-consummation due to inability
The marriage is not consummated because either party is unable to consummate it.
Non-consummation due to refusal
.The marriage is not consummated because one party willfully refuses to consummate it. Only the party who was refused to consummation can apply for an annulment.
Lack of consent to marriage
The lack of consent can be through duress, mistake or suffering from mental illness.
STD at time of marriage
If one spouse had a sexual disease at the time of marriage, and the other spouse was unaware of it, the innocent spouse can apply to annul the marriage.
Where the wife was already pregnant by another man at the time of marriage.
